APPEAL SUCCESS IN SUFFOLK

Our clients received the news this week we had all been striving to achieve, their appeal had been allowed for two detached five bedroom dwellings and access drive to serve the dwellings, rearranging the car park relating to the public house and the demolition of an existing garage together with landscaping in Cockfield, Bury St Edmunds. RSA were grateful to receive the following comments:

We had recently prepared the rebuttal statement relating to their appeal, as well as an award of costs application. RSA considered that the Council had acted unreasonably in refusing planning permission and the need for a Planning Inspector, appointed by the Secretary of State, to determine the application by way of an appeal.

Objection Statement "eloquent and well researched"

We recently prepared an objection statement for clients whose neighbour had submitted a planning application for a scheme which was below design standards and would have an adverse effect upon our clients' residential amenities. The objection was submitted to the planning officer considering the application and had regard to the proposed design and the relevant policies of the Council's Adopted Local Plan that the proposal was in conflict with.

Thanks for being honest

In the course of our work we do get asked to consider schemes that have had planning permission refused and would an appeal to the Secretary of State be a good idea. Sometimes the proposals that have been put forward are not a good scheme and would stand no chance at an appeal and unfortunately we have to give that news to the person concerned knowing it is probably not what they are expecting to hear. However, it was good to receive this comment in an email today, from such an applicant.

"My aim was to gain planning permission to build a single detached dwelling. After being denied planning permission for a third time even though I had adjusted my plans significantly to meet nearly all of the Council's conditions, I felt I was being treated unfairly and decided to appeal the decision. In doing so I wanted to enlist the assistance of a planning consultant. I had been quoted by some that were recommended by my architect but, as luck would have it, through the post came a letter advertising Ray's services.

After a few emails I could tell he would be able to offer a more thorough service and so the work began.
